Article 35A emerging hot debate in Kashmir

Srinagar, Jul 28 (KNB): After Supreme Court deferred hearing on petitions challenging Article 35-A in April, the court has expected to hear the argument on 6th August which permits only subjects of Jammu and Kashmir to get property in the state.


It is important to know, Article 35A was imposed by Maharaja Hari Singh in Dogra rule in Jammu and Kashmir that defined state subjects and their rights. In 1949 Popular Leader Shiekh Abudullah took over reins from Dogra ruler. He later negotiated J&K’s political relationship with New Delhi, which led to the inclusion of Article 370 in the Constitution.

While after the BJP- PDP breakup, this is first time the Supreme Court has expected to hear the petition from the challengers. From Civil society to Separatist leadership everyone in Kashmir has warned center against change in Article 35A.

Hurriyat M Chief Mirwaiz Umar Farooq earlier warned center “if it will you change the status of article 35A, People of Kashmir will hit the streets and resist it forcefully”.

Meanwhile, Civil Society Grand Mufti Nasir-ul-Islam, and Awami National Conference President, Muzafar Shah has called shutdown on 6 August and said Protecting 35A, 370 is responsibility of people of Kashmir.

“It may be very disturbing day if Article 35A, 370 will be changed, Kashmir will face worst time, we hope this will not happen,” said a youth Imtiyaz Ahmad.

Another youth from Kashmir while commenting on Article 35A said “Kashmir is suffering from last many years and removing the article 35A can bring more bloodshed to Kashmir Valley.”


Taking on Twitter Adtiya Raj Kaul Senior Associate Editor Republic Tv writes “Separatists and their boot-lickers in the Kashmir valley are nervous and sweating in the last stages of abolish Article 35A battle. Since their propaganda business and shops would shut after Article 35A/370 are withdrawn and thrown into the dustbin of history. All eyes on the SC”.

On last Independence Day Former Chief Minister jammu and Kashmir Mehbooba said “Have faith that Supreme Court will reject appeal to abrogate Article 35 A”.


On that occasion she also criticised those who approached Supreme Court challenging Article 35 A.
