For Governor Rule in J&K, in national interest

Prof.Bhim Singh, Chief Patron of National Panthers Party who had an opportunity to meet the President of India Shri Pranab Mukherjee and the Indian Prime Minister, Shri Narendra Modi in the past week in connection with the tense situation that has arisen in Kashmir following the total collapse of the government machinery and failure of the administration to maintain control over the situation for nearly two months. Hospitals closed, government offices shut, all the public enterprises including shops locked and the children are free to roam in the deserted streets. The total failure of the law and order enforcing machinery has failed which is evident that pellet guns are being used against the children resulting in death of several minors and hospitalization of hundreds of teenagers.




Prof.Bhim Singh respectfully submitted to the President of India when he met him in Rashtrapati Bhawan last week and the Prime Minister of India, Shri Narendra Modi yesterday only. Prof.Bhim Singh strongly pleaded with the Prime Minister to urge the President of India to invoke Section 92 of J&K Constitution to promulgate Governor Rule (Rashtrapati Shasan) which is only within the command of the Governor of J&K after he receives consent/recommendation of the Governor of J&K. Article 370 of Indian Constitution has vested constitutional authority in the President of India only to intervene into the affairs of J&K State which has not officially merged into the Union of India by virtue of Article 370 of the Indian Constitution. Article 370 prohibits the Parliament of India to interfere into the constitutional affairs of the State of J&K though the State was validly acceded to the Union of India on August 20, 1947.




Prof.Bhim Singh also mentioned before the Supreme Court of India this morning urging the Supreme Court to list the Panthers Party writ petition before it for appropriate action. The writ petition was filed in July, 2016 by J&K National Panthers Party urging the Supreme Court of India for its intervention to direct the President of India to advice the Governor of J&K to impose Governor Rule in J&K by dismissing the failed government in the state and dissolving the State Assembly.
