The rot in Technical Education Department in Kashmir is running deep. According to documents and details accessed by The Kashmir Scenario Directorate of Technical Education has violated norms to benefit their blue eyed officials .Notwithstanding the fact , Shri A.R.Hafiz who has been shown at S.No 3 in the seniority list of head clerks issued by the directorate vide No RTE10155-11357-3630 dated 21.2.2013 and published in the some newspapers on 23.02.2013 witnessed sharp criticism from all categories of ministerial cadre employees of ITI Sector.Shri Hafiz is junior to all other head clerks figuring in the list from S.NO 4 to 12 .
According to information available, the delegation of the ministerial cadre employees presented some documentary evidences before the union and told that Shri Abdul Rashid Hafiz was initially appointed as Workshop attendant vide order No 15 dated 12.4.80 issued by Director Industrial training institute and posted in ITI Bandipore.
It may be noted that Vide order no-15 dated 31.5.80.[after one and a half month]-issued by the Director, Industrial training institute in violation to cadre management rules governing SSR of Technical education Shri Hafiz was adjusted as junior Assistant in his own pay and grade in ITI shopian and attached to Direction office till further orders. In the said order it was however made clear that the illegal promote has no proficiency claim for promotion
As per J&K,Industrial training SSR1979 notified vide SRO 235 17.4.12979 the mode of recruitment for the post of junior Assistant was 100% by direct Recruitment . However 25% quota was fixed for orderlies provided they qualified the test which is conducted by Recruitment board.In this regard it is important to mention that Shri Hafiz was neither eligible for the said post nor qualified any kind of examination through recruitment board.Besides the post of workshop attendant belongs to technical cadre and not ministerial cadre. Even Administrative Department has not been empowered to change the cadre of an official, which has been made clear by the Government of Jammu and Kashmir, General Administration department vide their circular No 29.8.2003 issued vide endorment No GAD(Adm)257-203-in light of the honorable supreme court ruling in the case suraj prakash Vs state of J&K.
One is simply bamboozled by the fact that how and when the cadre of Shri A.R.Hafiz from technical cadre to ministerial cadre was changed and subsequently regularized as junior Assistant and then promoted as senior assistant and then checker is not known to anybody.
It is important to mention that in 1997 the Director, Technical education in a flimsy manner treating Shri Hafiz as senior assistant adjusted him as checker vide order No 618 of 1997 dated 27.1.1997 in his own pay and grade with the benefit of charge allowance and subsequently in absence of recruitment rules and without conducting the meeting of Departmental promotion committee. The Director technical education vide order no 38 of 99 dated 12.1.1999 placed the blue eyed official for his own vested interests retrospectively against the post of checker in the scale of 5000-8000.When Shri Hafiz was elevated against the post of checker no mode of recruitment was formulate by the Government for the said post. In 2002 the new recruitment rules came into force which were governed under SRO 145 of 2002 dated 10.4.2002,As per SRO 145 of 2002.The mode of recruitment for the post of tabulatorcheckerHead assistant was 100% by promotion from the category of senior Assistant with four years experience and having passed secretariat training courseAs a matter of fact Shri Hafiz was neither secretariat trained at that time nor eligible for promotion to the post of Tabulatorchecker as per recruitment rules governing SSR of Technical Education. Neither Director, technical Education itself was empowered to elevate any official to any post without convening the meeting of Departmental promotion committee.
All the promotions of Shri A.R.Hafiz from workshop attendant to junior Assistant, junior assistant to senior assistant, senior assistant to checker are illegal and in violation to recruitment rules and seniority.
The delegation of ministerial cadre employees of ITI Sector have reported time and again that Directorate of Technical Education has made self categorization of various employees as state cadre employees. The fact is that all the employees working in the Directorate of Technical Education and State Board of Technical Education belongs to Divisional cadres and there are no state cadre posts.
